Trainovo Terms of Service

1. Acceptance of Terms

By accessing or using Trainovo ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Description of Service

Trainovo provides trainers ("Trainers") with tools to manage billing, document sharing, and client administration. Trainers can add and manage their own clients ("Clients"), send documents, and collect payments through the Platform.

3. User Accounts

• Eligibility: You must be at least 18 years old or have legal parental/guardian consent.
• Account Registration: You agree to provide accurate information and keep it updated.
• Account Security: You are responsible for maintaining the confidentiality of your account and password.

4. Payments & Fees

• Trainers set their own prices for their services.
• Trainovo collects payments from Clients on behalf of Trainers and deducts a platform fee of 5% from the Trainer and a 7% service fee from the Client per transaction.
• All payments are processed through Stripe; Stripe's standard processing fees apply.
• Payouts to Trainers are made after platform and Stripe fees are deducted.

5. Refunds

• Refunds for services are at the discretion of the Trainer, unless otherwise required by law.
• Platform service fees may not be refundable except as required by law.

6. Prohibited Conduct and Content

You agree not to:

• Use the Platform for any unlawful purpose.
• Harass, abuse, or harm other users.
• Upload, post, or share any content that:
  • Is sexually explicit, pornographic, or contains nudity intended for adult audiences.
  • Promotes violence, discrimination, or illegal activity.
  • Infringes on third-party rights or is otherwise objectionable.

Trainovo reserves the right to remove any content that violates these guidelines and to suspend or terminate accounts at its discretion.

7. Content Ownership and License

• Your Content: You retain ownership of any content you upload but grant Trainovo a non-exclusive, royalty-free license to use it for platform operation and promotion.
• Platform Content: All Trainovo branding, logos, and software are the property of Trainovo.

8. Termination

Trainovo reserves the right to suspend or terminate your account for any violation of these Terms.

9. Disclaimers

The Platform is provided "as is" without warranties of any kind. Trainovo does not guarantee results or outcomes from the use of the Platform.

10. Limitation of Liability

To the maximum extent permitted by law, Trainovo shall not be liable for any indirect, incidental, or consequential damages.

11. Changes to Terms

Trainovo may modify these Terms at any time. Continued use after changes constitutes acceptance.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law principles. You agree that any dispute or claim arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Salt Lake County, Utah, United States, and you consent to personal jurisdiction in those courts.
